CPRA Privacy Notice for California Residents

This privacy policy notice applies to California residents whose personal information may have been provided by you or your company to BSH Home Appliances Corporation and its affiliated companies (“BSH”) as part of your company’s current business relationship with BSH. This privacy policy notice describes the categories of Personal Information (“PI”) collected by BSH and the purposes for which such PI may be used. Personal Information refers to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. We are providing this notice to you in accordance with the California Consumer Privacy Act as amended by the California Privacy Rights Act and accompanying regulations (collectively the “CPRA”).
§ 1

Purposes of Collection and Use of Personal Information

BSH collects and processes Personal Information for the following business purposes:

  • To aid in receiving the service provided by your company to BSH, including being able to contact the appropriate personnel of your company.
  • To pursue contractual obligations between BSH and your company, including debt collection activities.
  • To comply with applicable state and federal laws.
  • For those affiliated with dealers and other trade partners, to process your sales-related bonus (e.g., SPIFFs) and provide tax documentation for such bonuses.
  • For those affiliated with dealers and other trade partners, to provide educational training videos at the request of your dealer company and only based on your consent to participate in such education training videos. Please note that if a dealer or other trade partner requests these educational training videos, BSH instructs all participants to turn off their cameras and refrain from discussing any Personal Information during these educational training sessions.
Please note that we do not use your Sensitive Personal Information for purposes other than those set forth in Cal. Code Regs. tit. 11 § 7027(m).
§ 2

Sources of Personal Information

BSH primarily collects Personal Information directly from your company or from you. In limited situations, BSH may collect Personal Information from third parties.

§ 3

Categories of Personal Information BSH May Collect

  • Identifiers — such as name, postal address, phone number, email address, and other similar identifiers.
  • Social Security Number Sensitive Personal Information— may be collected only for those affiliated with dealers or other trade partners, and only for the purpose of processing sales-related bonuses (e.g., SPIFFs) and provide tax documentation for such sales-related bonus.

Recipient of Personal Information

For purposes of the CPRA, BSH does not sell or share the categories of Personal Information listed in Section 3. However, BSH may disclose Personal Information to the categories of Recipients identified below.

  • Affiliates — We may transmit your Personal Information (including Sensitive Personal Information) to our affiliates as part of internal group services, such as central IT systems.
  • Service Providers — Within the scope of its legal obligations, BSH transmits Personal Information to recipients outside BSH, such as third parties who process Personal Information on behalf of BSH. Such processing takes place under strict legal requirements. Service providers can only use Personal Information to provide such services to us and for no other purpose. The following categories of recipients may process your Personal Information on behalf of BSH:
    • Postal operators.
    • Software companies supporting business functions.
    • Vendors supporting business functions.
  • Public Authorities and Legal Proceedings — BSH may disclose your Personal Information if we are obligated to do so due to legal provisions, enforceable administrative or court orders, or pursuant to a request from a governmental entity, or if we believe in good faith—after considering your privacy interests and other factors—that such action is necessary to:
    • Meet legal requirements or comply with legal processes (e.g., subpoenas)
    • Enforce our terms of use and contracts, including for billing and collections.
    • Protect our rights and safety (including property rights) or the rights and safety of a third party, our affiliated companies, or the public.
    • Stop activity that we consider illegal, unethical, or legally actionable.
  • Corporate Transaction or Proceeding. We may also disclose your Personal Information to a third party in the event of reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any of our business, assets, or stock, including in connection with a bankruptcy or similar proceeding.
  • With Your Consent. Finally, we also may disclose your Personal Information if you consent to such a disclosure.

Disclosure or Sharing of Personal Information Within the Last 12 Months

If this is the first time your company has provided your Personal Information to BSH, then BSH has not provided your Personal Information for a business purpose to third parties in the preceding 12 months.

If you or your company previously provided your Personal Information to BSH, then BSH may have disclosed or shared the following categories for a business purpose in the past 12 months:

Note: If you voluntarily provide Sensitive Personal Information, BSH will not use it for purposes other than those set forth in Cal. Code Regs. tit. 11, § 7027.
§ 6

Duration of Storage of Personal Information

Your Personal Information will initially remain stored by BSH for as long as is necessary for the respective purpose of processing. If the purpose for processing is achieved or no longer applicable, BSH may continue to store your Personal Information to the extent that BSH is legally obligated to or entitled to store this data.

§ 7

Children's Privacy

We do not knowingly collect Personal Information from children under the age of 16. If we discover or are notified that we have collected Personal Information from a person under age 16, we will delete that information from our systems.

Sale or Sharing of Personal Information

As indicated above, BSH does not "sell" or "share" (as these terms are defined under the CPRA) your Personal Information and therefore does not provide a mechanism to opt out of such disclosures.

Your CPRA Rights

Right to Know or Confirm What Personal Information is Collected

You may request that we disclose to you the following information:

  • The categories of Personal Information BSH has collected about you.
  • The categories of sources from which the Personal Information was collected.
  • The business or commercial purpose for which BSH collected your Personal Information.
  • The categories of third parties to whom BSH discloses Personal Information
  • The specific pieces of Personal Information BSH has collected about you.

Right to Request Deletion of Your Personal Information

You may request that we delete any Personal Information that we have collected from you, provided that we may retain Personal Information as authorized under CPRA, including, but not limited to, retaining Personal Information necessary to detect security incidents, comply with a legal obligation, or otherwise use your Personal Information internally in a lawful manner that is compatible with the context in which you provided it.

Right to Correct Inaccurate Personal Information

You may request that we correct inaccuracies in your Personal Information.

Right of No Retaliation Following Exercise of CPRA Rights

We will not discriminate against you if you exercise your CPRA rights.

Include your name, address, and phone number or email in all communications and state clearly the nature of your request. Our response to your request will be sent from bsh-us-dataprotection@bshg.com. Our response, including any Personal Information, may be sent as an encrypted file.

To process your request, BSH may need to verify your identity using commercially reasonable means. BSH will send a receipt acknowledging your request within 10 days and endeavors to respond within 45 days. If more time is required, the process may be extended by an additional 45 days (90 days total), as permitted under the CPRA. BSH will inform you of any extension in writing.

As a California resident, you have the right to designate an agent to exercise these rights on your behalf. When you submit a request through an authorized agent, we may require that you (i) provide us a copy of your written permission for the authorized agent to submit the request, and (ii) verify your own identity directly with us. Changes to This Notice

This Notice may change from time to time, effective as of the "Last Updated" date at the top of this Notice.
