This privacy policy notice applies to California residents whose personal information may have been provided by you or your company to BSH Home Appliances Corporation and its affiliated companies (“BSH”) as part of your company’s current business relationship with BSH.  This privacy policy notice describes the categories of Personal Information (“PI”) collected by BSH and the purposes for which such PI may be used. We are providing this notice to you in accordance with the California Consumer Privacy Act and the California Privacy Rights Act (collectively referred to as “CPRA”).

1.      Purposes of processing.

 

The processing of your Personal Information serves the following business purposes:

 

·        To aid in receiving the service provided by your company to BSH, including, but not limited to, being able to contact the appropriate personnel of your company.

·        To pursue contractual obligations between BSH and your company, including, but not limited to, pursuing any debt collection activities.

·        To comply with applicable state and federal laws.

·        For those affiliated with our dealers and other trade partners, process your sales-related bonus (e.g. SPIFFs) and provide tax documentation for such sales-related bonus.

·        For those affiliated with dealers and other trade partners, to provide educational training videos at the request of your dealer company and only based on your consent to participate in such education training videos.  Please note that if a dealer or other trade partner requests these educational training videos, BSH instructs all participants to turn off their cameras and refrain from discussing any Personal Information during these educational training sessions.

 

Please note that we do not use your Sensitive Personal Information for purposes other than those set forth in Modified Proposed CPRA Regulations § 7027.

 

 

2.     Categories of sources from which your Personal Information is collected.

 

In most cases, BSH Company collects Personal Information directly from your company or from you. In a few cases, BSH Company may collect your Personal Information from third parties.

 

3.      Categories of Personal Information that we may collect.

 

·       Identifiers such as name, postal address, phone number, email address, and other similar identifiers. 

·       Social security number (Sensitive Personal Information) - only for those affiliated with our dealers or other trade partners, and only for the purposes of processing your sales-related bonus (e.g. SPIFFs) and provide tax documentation for such sales-related bonus.

4.     Recipient of your Personal Information.

 

Within the scope of its legal obligations, BSH transmits your Personal Information to certain recipients outside BSH, such as external third parties who may process your Personal Information on behalf of BSH.  Such processing takes place under the strict legal requirements for commissioned data processing. The following categories of recipients may receive your Personal Information in order to process them on behalf of the BSH:

 

·        Postal operators.

·        Software companies supporting business functions.

·        Vendors supporting business functions.

 

BSH may also transmit your Personal Information to our affiliates as part of our internal group services (such as provision of central IT systems).

We may disclose your Personal Information if legally required to do so, pursuant to a request from a governmental entity, or if we believe in good faith – after considering your privacy interests and other factors – that such action is necessary to:

·        Conform to legal requirements or comply with legal processes (including subpoenas).

·        Enforce or apply our terms of use and other agreements, including for billing and collections purposes.

·        Protect our property rights, rights and safety or property, rights and safety of a third party, our affiliated companies, or the public in general.

·        Stop any activity that we consider illegal, unethical, or legally actionable.

 

We may also disclose Personal Information to a third party in the event of reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any of our business, assets, or stock, including in connection with bankruptcy or similar proceedings.

Finally, we also may disclose your Personal Information if you consent to such a disclosure.

·       Social security number (Sensitive Personal Information) - only for those affiliated with our dealers and other trade partners, and only for the purposes of processing your sales-related bonus (e.g. SPIFFs) and provide tax documentation for such sales-related bonus.

 

 

Public authorities and legal proceedings: BSH may disclose Personal Data about you to government or law enforcement officials or private parties as required by law, and disclose and use such information as we believe necessary or appropriate to (a) comply with applicable laws and lawful requests and legal process, such as to respond to subpoenas or requests from government authorities; (b) protect our rights, privacy, safety or property, and/or that of you or others; and (c) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity.

Parties to a corporate transaction or proceeding: In the event of a corporate sale, merger, reorganization, bankruptcy, dissolution or similar event, Personal Data may be part of the transferred assets.

 

1.     Our Policy with Respect to Children

 

We do not knowingly collect PI from children under 16.

 

2.     Duration of storage of your Personal Information

 

Your Personal Information will initially remain stored by BSH for as long as is necessary for the respective purpose of processing, or up to the time period specified by BSH’s data retention policies, whichever is longer. If the purpose for processing is achieved or no longer applicable, or the BSH data retention period has been achieved with respect to job applications, BSH may continue to store your Personal Information to the extent that BSH is legally obligated to or entitled to store this data.

 

3.     BSH does not “sell” or “share” (as these terms are defined under CPRA) your Personal Information. Given that we neither “sell” nor “share” Personal Information for CPRA purposes, we do not provide a mechanism to opt out of such disclosures.

 

4.     You have the following rights under the CPRA:

 

a)    Right to request deletion of your Personal Information that we have collected from you, provided that we may retain Personal Information as authorized under CPRA, including, but not limited to, retaining Personal Information due to legal reasons, detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, enable solely internal uses that are reasonably aligned with your expectations based on the your relationship with us, comply with a legal obligation or otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which you provided it.

 

b)    Right to request correction of inaccurate Personal Information maintained by BSH in accordance with CPRA.

 

c)     Right to request to know about Personal Information in accordance with CPRA:

(1) The categories of Personal Information BSH has collected about you;

(2) The categories of sources from which the Personal Information was collected;

(3) The business or commercial purpose for which it collected your Personal Information;

(4) The categories of third parties to whom BSH discloses Personal Information;

(5) The specific pieces of Personal Information BSH has collected about you.

d)    Right of no retaliation. We will not discriminate against you if you decide to exercise one of the rights listed above.

In order to submit a request, we may need to verify your identity by using commercially reasonable means.  Please note that following your verified request, we will send you your Personal Information from the following email address: bsh-us-dataprotection@bshg.com (Any response to your request, including any Personal Information may be sent as an encrypted file).

Please note that once you have submitted a request, we will send you a receipt, acknowledging your request, within 10 days. If, for some reason, you do not receive such a receipt within 10 days of your submitted request, please send us an email to bsh-us-dataprotection@bshg.com as an error may have occurred.

We will process and respond to your request within 45 days after it is received (in some cases, as is allowed under the CPRA this process may be extended by an additional 45 to 90 days).

As a California resident, you also have the right to designate an agent to exercise these rights on your behalf. We may require proof that you have designated the authorized agent to act on your behalf and to verify your identity directly with us. Changes to This Privacy Policy

This Privacy Policy may change from time to time, effective from “Last Updated” date at the beginning of this Privacy Policy.
